Hi all,
I am descended from this Cox confusion also. I found the transcript of the
will of John Garretson van der Hoff very interesting. I also have a
photocopy of the microfilmed original will which I ordered from the Hall of
Records in Dover, Delaware. It is stamped as being a copy of the original in
the custody of the Division of Historical and Cultural Affairs, from Book B,
pages 13-14, New Castle County Wills. However, my photocopy of the
"original" doesn't have the kind of random capitalization and spelling that
might be expected from that era or that the transcript in your message shows
. I wonder if the copy that the Delaware Archives has isn't a copy of the
entire will book made at some later date (it is handwritten).
"A Calendar of Delaware Wills, New Castle County 1682-1800", abstracted and
compiled by The Historical Research Commmitee of the Colonial Dames of
Delaware (1991 Heritage reprint of original published in 1911) shows the
following abstract (p.9):
"John Garretson. Nov. 28, 1694. Mar. 5, 1694. B. 13. Three sons, Garott,
Casper and Cornelius. "Thayor mother," Ann; daughters; wife, Ann.
I thought I would give you another transcript of the will copy I have, which
is a little longer and has the slight difference that Garret is rendered as
Gerhard in the will. Some words were impossible for me to read because the
photocopy was too light.
"The last will and Testament of John Garretson Vanderhof made the 28th day
of November 1694 being sick and weak but in perfect memory -
I give my Spirit to God and my body to the ground I give all my land unto
my three sons that is Gerhard, Casper, and Cornelius after the decease of
Ann their mother, or if the said Ann their Mother should marry [--?--] when
my sons shall come to age they shall have all the land, It is my will that
it shall be equally divided between them, that is to say my eldest son
Gerhard to have my home plantation with the equal co---tation of land as my
other two sons have
Item It is my will that my son Gerhard shall help with the ?Land of my
other two sons in clear__ as much land as the home plantation have and to
build housing convenient for them, also the land that Casper and Cornelius
have it must be divided, and then they must cast lots for their settlement,
also the stock that I have gave him they doe [--?--] and the stock that is
mine and my wifes after both our decease it shall be equally divided,
between my sons and my daughters that is to say my Cattle and hoggs and if
my loving wife Ann should marry then it is my will that she shall have her
thirds of the moveables and noe more.
Item It is my will that my three sons that is Gerhard, Casper, and
Cornelius when they come to age they shall give my daughters five pounds
each, and if any of my daughters should dye before they are married then my
sons must and shall equally divide it between them. As witness my hand and
Seal"

The son Cornelius mentioned in the will apparently never married (or at
least had no surviving issue) because he leaves a fascinating will in 1765
naming many of his nieces and nephews. Unfortunately, he refers to all his
relations of whatever degree as "cousin" so I find it confusing trying to
figure out what generation he is referring to. The copy I have of his will
also came from the Hall of Records in Dover, Delaware. It is stamped as
being a copy of the original in the custody of the Division of Historical
and Cultural Affairs, RG22545, Reel 162, New Castle County Register of
Wills.

Morton's estate); land to be held in severalty for their natural lives only;
get 3 cows, 2 mares, 6 sheep, 2 sows, wearing cloathes, beds & bed clothes.
My Negro boy Cuff given to my cousin William Garritson of Conawauga to
learn weaver trade until he reaches age of 25 when he is to be free.
My Negro boy John given to my cousin Jediah Garritson of Newport to learn
weaver trade until he reaches age of 25 when he is to be free.
My Negro Girl Moll given to Mary Jaquet, daughter of Anthony Jaquet
until Moll is 20 years old when she is to be free.
All my real estate to my cousins John & William Garritson, the sons of
my brother Casparus, to be equally divided between them (including the land
held by the 3 Negroes Grace, John & Joe until they are all dead). My cousin
William Garritson shall pay 50 pounds to his brother Joseph Garritson as
soon as William has possession of the land given to him.
To my cousin John Garritson's son Cullender Garritson, 12 pounds to be
paid by my cousin John Garritson after he comes into possession of the land
given to him.
To be paid by my cousin John Garretson son of Casparus Garritsin - to
my cousin Ann Hussey 16 pounds; to my cousin --?-- 10 pounds; to my cousin
Huld[?er] Lembro 20 pounds; to my cousin Mary Scot 10 pounds.
To be paid by my Executors: To my cousin James Garretson son of
Cornelius Garretson 10 pounds; To my cousin Sarah Garretson --------------
10 pounds; to my cousin Elizabeth Garretson 10 pounds; to my beloved friend
Anthony Jaquet 10 pounds.
To my cousin Jediah Garretson the residue of all my movable estate.
