I just tried a LOE with the filter:
State = [?]

And the report ran just fine with 5.09.000. I tried both qualifying and
nonqualifying entries.

I think what happened is I left the [?] blank. I just retried it with the
correct parameter and it worked fine!!!! A case of the can't see the forest from
the trees
